Terms of Service
1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of Kuru ("Kuru," "we," "our," or "us"), including the website located at kuru.com, related subdomains, and any services, content, or products made available through them (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to use the Service or make a purchase. By using the Service you represent that you meet these requirements. If you are using the Service on behalf of an entity, you represent that you are authorized to bind that entity to these Terms.
3. Accounts
Some features require an account. You agree to provide accurate information, keep your credentials secure, and accept responsibility for activity under your account. We may suspend or terminate accounts that violate these Terms, abuse the Service, or create risk for Kuru or other users.
4. Products, Pricing & Availability
Kuru operates a curated marketplace for aftermarket automotive parts. Product descriptions, fitment data, images, specifications, and pricing are provided for reference and may contain errors. We reserve the right to correct errors, change prices, limit order quantities, and refuse or cancel any order at any time, including after an order has been placed. Availability is not guaranteed until your order ships.
5. Fitment Disclaimer
Chassis codes, engine codes, and year/make/model fitment data are best-effort and sourced from manufacturers, suppliers, and public databases. You are solely responsible for verifying that a part fits your specific vehicle before installation. Modifications to suspension, drivetrain, engine, exhaust, aero, braking, or lighting components may be illegal for street use in your jurisdiction, may void your vehicle's warranty, and may require professional installation or tuning to operate safely. Kuru does not provide installation, tuning, or legal-compliance advice.
6. Orders, Payment & Taxes
By placing an order you authorize us (or our payment processors, including Stripe, PayPal, and Affirm) to charge your selected payment method for the order total, including applicable shipping and taxes. All prices are listed in U.S. Dollars (USD) unless otherwise noted. You are responsible for any duties, import fees, or taxes assessed at the point of delivery for international orders.
7. Shipping, Dropshipping & Delivery
Many products are fulfilled directly by overseas or domestic supplier partners under a dropshipping model. Delivery windows are estimates and not guarantees. Risk of loss and title pass to you upon delivery to the carrier. Tracking, when available, is provided for your convenience. We are not responsible for carrier delays, customs holds, or misdelivery caused by incorrect addresses.
8. Returns, Refunds & Warranty
Returns are accepted within 30 days of delivery for new, unused, uninstalled items in original packaging, subject to supplier policies and restocking fees (typically 15–20%). Electrical components, custom-order items, and installed parts are non-returnable. Manufacturer warranties, where provided, are passed through to you; Kuru makes no independent warranty beyond the limited warranty, if any, stated on the product page. 9. User Content
If you submit builds, photos, comments, reviews, or other content ("User Content"), you grant Kuru a worldwide, royalty-free, sublicensable license to host, display, reproduce, modify, and distribute that content in connection with operating and promoting the Service. You represent that you own or have the rights to post the content and that it does not infringe any third-party rights, violate law, or contain malware.
10. Prohibited Conduct
You agree not to: reverse engineer, scrape, or overload the Service; upload viruses or malicious code; infringe intellectual property; harass, threaten, or impersonate others; use the Service for resale, competitive benchmarking, or unauthorized commercial purposes; or circumvent access controls, rate limits, or payment systems.
11. Intellectual Property
The Kuru name, logo, branding, site design, curated content, and all software are owned by Kuru or its licensors and are protected by copyright, trademark, and other laws. Nothing in these Terms transfers ownership to you. Product names, logos, and trademarks shown on listings belong to their respective owners and are used for identification only.
12. Disclaimers
THE SERVICE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. KURU DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY PART WILL FIT OR PERFORM AS DEPICTED.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KURU AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID KURU IN THE 90 DAYS BEFORE THE CLAIM OR (B) USD $100.
14. Indemnification
You agree to defend, indemnify, and hold harmless Kuru from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your User Content, your violation of these Terms, or your installation or use of any product purchased through the Service.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California, excluding conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction there.
16. Changes to the Terms
We may update these Terms from time to time. Material changes take effect when posted on this page, and we will update the effective date above. Your continued use of the Service after changes take effect constitutes acceptance.
